The following Terms and Conditions (T&C) shall apply to you as a user of the Picster website. By completing a booking on Picster, you unequivocally agree to the below T&C. Furthermore, Picster also reserves the right to change, amend in part or in whole, these T&C. As a result of any future changes, the terms applicable in the future may vary from those applicable in this instance. At no time should Picster be obliged to inform you of these changes.
1. Overview
Picster offers an internet-based service through its website (Site), third party channels and social media outlets. Through one of these mediums, you are given the opportunity to book a photoshoot in several countries and cities around the world by selecting a product. Protecting our customers’ private information is our highest priority. These T&C also cover the Privacy Policy and governs all data collection and usage by Picster, including through the Site. By using the Site, you consent to the data collection and usage practices described in this Policy.
2. Data Collection
Picster may collect personal data about you and your shopping behaviour, past travel experiences, which includes but is not limited to your name and email, billing and credit card information, demographic information such as age and gender, with the aim to give you a better experience and show you relevant information, and to complete the purchase transaction.Picster makes use of cookies to help you personalise your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer.Picster stores information about your computer hardware and software. This information can include: your IP address; browser type; domain names; access times; and referring website addresses. This information is used for the operation of the Service, to maintain quality of the Service, and to provide general statistics regarding use of the Site. By using Picster you agree to allow Picster to collect your personal information. Your information will not be sold or given to other third-party services/products not related to Picster.Picster encourages you to review the privacy statements of websites you choose to link to from the Picster website so that you can understand how those websites collect, use and share your information. Picster is not responsible for the privacy statements or other content on websites outside of the Site.
3. Use Of Your Personal Information
Picster collects and uses your personal information to operate the Site and deliver the services you have requested. Picster may also use your personally identifiable information to inform you of other products or services available from Picster and its affiliates. Picster does not sell, rent or lease its customer lists to third parties. Picster may keep track of the websites and pages our users visit within Picster in order to determine what Picster services are the most popular. This data is used to deliver customised content and advertising within Picster to customers whose behaviour indicates that they are interested in a particular subject area.Picster will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Picster or the site; (b) protect and defend the rights or property of Picster; and, (c) act under exigent circumstances to protect the personal safety of users of Picster, or the public.
4. Security Of Your Personal Information
Picster secures your personal information from unauthorised access, use or disclosure. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.
5. Email & Promotions
Picster from time to time will contact you through email, push notifications, SMS, or other medium, to update you of special promotions or things that are going on with Picster. But using this service you agree to subscribe to receiving these emails and messages. You can unsubscribe at any time by clicking our unsubscribe button at the bottom of the email or by contacting our support team.
6. Opt Out & Unsubscribe
We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from Picster by contacting us using the contact information listed in the Contact Information section of this Policy.
7. Copyright
Picster and you as our client will own the copyright of the pictures from your photoshoot. The photographer however does not own the copyright. By using Picster you agree to let Picster use the photoshoot pictures at its own discretion on the media channels owned by Picster, including but not limited to the Picster BLOG, INSTAGRAM ACCOUNTS, HOMEPAGE, APPS.You acknowledge that Picster will own the copyrights of all the photos that Picster created and produced, and we reserve the right to use them to promote the Picster business, therefore, you agree to give Picster consent for all the photographs and videos produced by Picster to be published, displayed or used for the benefit of Picster (e.g. editorial, and exhibition) and to release all the rights to claim for any the profit or further compensation, in whatsoever manner, that may arise from such use.However, Picster will make every effort not to use your pictures in external media channels not owned by Picster, without your permission. You agree to release Picster and the relevant photographer from all liability for libel, invasion of privacy, and all causes of action whatsoever in relation to the photos their making and use, you or your property including without limitation any liability for alteration of the photos, whether intentional or otherwise, that may occur during the making, editing or subsequent use of the photos.We really respect our clients' privacy. Therefore, we won’t be using your photos for promotional purposes if you don't let us. You can choose your photo status later once your photos are uploaded or you can contact our client relations team to set your photo status up.
8. Booking Time Photoshoot Duration
Picster acts as a reservation system for photographers. By booking a photoshoot for example from 4pm till 6pm, you only have them available for you during those 2 hrs. If you choose to travel from point A to B, that will be part of the 2-hour reservation. Should you come late to the photoshoot, that will also be deducted from the 2-hour photoshoot.The photoshoot will run only on the time that clients booked (e.g. 1 hour or 2 hours). If you come late, the time will be deducted from the session. If your session time runs more than your initial, there may be an additional fee applied. You can move to different locations as long as they’re near to each other or can be reached within walking distance. The travel time is included in your photo session.
9. Tax
Photoshoots will be subject to the Value Added Tax of the specific country.
10. Payment Method
We accept all / most forms of payment methods, including PayPal, Credit Card, and all major European providers.
11. Photo Editing Time
Max 48 hours after the photoshoot.
12. Editing
Picster’s editing team will edit all the images we provide to you. You can select and download the image after it has been edited. We edit for brightness and colour. We do not photoshop images to make people look slimmer, thinner, or remove objects. We edit to bring out the beauty of the photoshoot. Picster has its own editing style. You cannot request your own editing style. Photographer’s personal portfolios will look very different to Picster photoshoots, due to our editing style.
13. Travel Expense
Our photographers are local photographers in the city where you will do the photoshoot. Therefore, there are no travel or accommodation expenses. However, if you want your photoshoot to happen on places around 1 hour away/more from the city centre or already located outside the city, please check with our support team prior to your booking because additional fee may apply.
14. Other Expense
Entrance fees to such places like Theme parks are not included in the 2-hour fee. Should there be an entrance fee, you will have to pay for the entrance fee for the photographer.
15. Theft
Picster and the photographer are not responsible for theft during the duration of your photoshoot.
16. Cancellation and Reschedule Policy
Free cancellation and reschedule are only applicable if you submit your cancellation or reschedule request +24 hours (1 full day) before your photoshoot date. There will be a certain amount of penalty if you submit afterwards.

17. Injury
By booking a photo session with Picster you waive or give up certain legal rights, including the right to sue of claim compensation following an accident, now or in the future. You agree to waive any and all claims, and release Picster and the photographer from all liability and agree not to sue Picster and the photographer, which can be a company, for any personal injury, death, property damage or other loss that I sustain during or as a result of a Picster photo session. You as a client, hereby agree as follows:To waive all claims that I have or may in the future have against Picster and the photographers, and to release Picster and the photographers from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my next of kin may suffer as a result of my participation in Picster photo sessions, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care on the part of Picster and/or the photographer.To hold harmless Picster and the photographers from any and all liability for any property damages or personal injuries to any third party resulting from my participations photographic activities or related activities to the photoshoot, which might include walking, hiking, climbing, getting on a boat, or other activities that are related to the photoshoot;
18. Changes To This Policy
Picster will occasionally update this Privacy Policy to reflect company and customer feedback. Picster encourages you to periodically review this Policy to be informed of how Picster is protecting your information.
